Commercial slide copyright restrictions

Carolina has given permission for us to post photos of their slides here, with the restriction, "A copyright statement must appear with each photomicrograph taken of a Carolina Biological Supply Company created human tissue microscope slide, such statement to read as follows:©Carolina Biological Supply Company, Burlington, N.C., Used with permission." Ward's will allow us to post their images with the condition that photos are labelled as coming from a Ward's slide. 3 out of 3 found this valuable. Do you? |

How do we know which company the photographs of the tissue came from? I would like to post my powerpoint on my college backboard site for my students, but I would like to make sure that the college and I are covered and not in copywrite violation.

Most of the slides posted are my own, obtained by donation from hospital pathologist friends of mine from my former surgical practice. If there is no label identifying the slide as a commercial source, please assume that the slide is non-commercially donated to us as HAPS members to use and display as we see fit. As such, you do not need any attribution, but if you wanted to cover yourself, simply annotate as "publically donated by HAPS". The non-labeled photos are free for you to use anytime, anywhere - true public domain. The commercially labeled slides should only be used in teaching and not distributed onto public bulletin boards to end up who knows where. This is my understanding after interacting with Carolina and Wards. It is therefore the responsibility of the photo posting member to label his source when it is from a commercial source.

Yes,I understand what to put, but from looking at the pictures posted on this website how do we know from the picture which were from Carolina and which were from Wards or of their production. I have not seen anywhere in or on any picture or elsewhere that tells me the source of the slide. Maybe I have over looked it, if so, please let me know where to look so I can give the correct credit. Thanks for your help.

One commercial slide has been posted under Thumbnails --> Tissue Type Thumbnails --> Simple Cuboidal Epithelium, and when the cursor hovers over it, the label (Turtox) appears. If you click on that page and see the master image, you can see the image was last modified by LindaMoussakova. It is really up to the person who posts the image to include the commercial information, and where on the page they do so. Are you suggesting some specific format / location?

Did Linda snag the IMAGE of the slide from Turtox, or did she take the photo herself, and just add the source (either as acknowledgement, or for the benefit of others who might want to acquire the slide). Images are copyrighted, but as far as I know the tissue slide itself cannot be copyrighted. I suggest we have a policy that members post only images that they took themselves, and not any images snagged from other sources. Do you find this valuable? |

I agree with the policy that members post only their own images and not snag from other sources. That said, the slide companies request acknowledgement when we photograph their slides. I see no harm in honoring their request. They do give us freedom to publish the photos taken from this site in our own educational material. I remain unclear on the legal requirements. My own understanding is that on one hand, one cannot copyright natural materials, on the other, one can copyright the organization and processing of materials. Where in this legal gray zone do slides fit that contain natural tissue, commercially prepared? I have not been able to find a clear legal precedent. All of the slides I have personally added to this site come from non-commercial donated material. Is anyone here an expert on copyright law that can quote a relevant case & number?
